Sen. Bob Menendez Found Guilty in Corruption Trial

On July 16, 2024, Senator Bob Menendez (D-NJ) was found guilty on multiple charges of corruption. This verdict marks the culmination of a high-profile trial that has garnered widespread media attention and raised questions about ethical standards in politics.

Prosecutors in New York alleged the New Jersey Democrat accepted hundreds of thousands of dollars in bribes in the form of cash, gold bars, mortgage payments and more in exchange for the senator's political clout. Menendez was convicted on all 16 counts, including bribery, obstruction of justice, acting as a foreign agent and honest services wire fraud. The jury deliberated for 13 hours total after an explosive two month long trial, which featured jurors being able to hold a gold bar that the government says was found in a search of Menendez's house.

Prosecutors argued that Menendez accepted lavish gifts and campaign contributions in exchange for political favors, a claim he consistently denied throughout the trial. This is the second federal criminal trial for Menendez. He was indicted in 2015 on unrelated federal corruption and bribery charges that resulted in a mistrial. The evidence presented in this case, however, convinced the jury of his guilt, leading to this landmark verdict.

The political fallout from the verdict has been strong already. Senate Majority Leader Chuck Schumer issued a statement calling for Menendez's resignation, underscoring the seriousness of the conviction and its incompatibility with holding public office. Schumer's statement reflects the broader sentiment within the Democratic Party, which is now grappling with the implications of having a senior member convicted of corruption. His statement read, “In light of this guilty verdict, Sen. Menendez must now do what is right for his constituents, the Senate, and our country, and resign.”

Separately, the Governor of New Jersey released a statement calling for his home state senator’s resignation. “Today's verdict finding Senator Bob Menendez guilty on 16 counts demonstrates that the Senator broke the law, violated the trust of his constituents, and betrayed his oath of office. It also shows that in America, everyone – no matter how powerful – is accountable to our laws.”

“I reiterate my call for Senator Menendez to resign immediately after being found guilty of endangering national security and the integrity of our criminal justice system. If he refuses to vacate his office, I call on the U.S. Senate to vote to expel him. In the event of a vacancy, I will exercise my duty to make a temporary appointment to ensure the people of New Jersey have the representation they deserve.”

The Senate Ethics Committee, conducting its own review of Senator Menendez’s activities, announced it "will complete its investigation promptly" and will "consider the full range of disciplinary actions available."

Next Steps

Senator Menendez has not yet made a public statement, but he will need to make a decision on his future. If he refuses resignation, Democratic and Republican colleagues in the Senate have already made comments leaning towards expulsion, which would require a two-thirds majority vote. The Senate has only expelled 15 senators in history and hasn’t done so since the 19th Century. He will also join the short list of 7 senators who have been convicted of a federal crime. Menendez maintains his innocence, and has vowed to appeal his conviction though he is scheduled to be sentenced on Oct. 29 and faces decades in prison.
